Terms of Service

FramePicks is currently in controlled beta. These Terms may be updated before public launch.
1. Acceptance of Terms
FramePicks provides private photo proofing tools for photographers and their clients. By creating an account, uploading content, sharing a gallery, accessing a gallery, or otherwise using FramePicks, you agree to these Terms of Service.
If you do not agree, do not use FramePicks.
2. Beta Status
FramePicks is currently in controlled beta. Features may change, break, be removed, or be discontinued without notice.
Do not rely on FramePicks as your only record of client selections or as permanent photo storage. Photographers should maintain original files and independent records of client selections and project details.
3. Account Eligibility and Approval
Photographer accounts require manual approval. FramePicks may approve, deny, suspend, or remove accounts at its discretion.
Clients do not need accounts to access private proofing galleries. Gallery access depends on private links shared by the photographer.
4. Photographer Responsibilities
Photographers are responsible for the images they upload and share through FramePicks. This includes obtaining any required rights, permissions, model releases, subject consent, client consent, event or venue permissions, and any other authorizations required by law or applicable agreements.
Photographers are responsible for complying with their client agreements and applicable laws. FramePicks is not responsible for disputes between photographers and their clients.
5. User-Uploaded Content
Photographers retain ownership of uploaded images. FramePicks does not claim ownership of uploaded photos.
By uploading content, photographers grant FramePicks a limited license to host, store, compress, display, transmit, and process the content only as necessary to operate, secure, troubleshoot, and improve the service. This license ends when content is deleted, subject to temporary retention in backups, logs, and service-provider systems.
6. Image Rights and Copyright
Image rights remain with the photographer or the applicable rights holder. FramePicks is only the platform hosting the proofing gallery.
Clients and gallery viewers do not receive any rights to download, copy, edit, post, share, repost, screenshot, remove watermarks, or otherwise use proof preview images unless expressly permitted by the photographer.
7. Client Gallery Rules
Clients and gallery viewers may use galleries only to view proof previews, select favorites, and leave optional comments.
They may not download, screenshot, copy, edit, repost, share, remove watermarks, use images commercially or publicly, or share gallery links without explicit permission from the photographer.
8. Prohibited Uses
Users may not use FramePicks to upload, share, or distribute:
- Content that infringes third-party rights
- Illegal, exploitative, abusive, or harassing content
- Non-consensual intimate imagery
- Malware, spam, or deceptive content
- Content you do not have rights to upload or share
Users may not attempt to access galleries or accounts without authorization, or attempt to bypass, test, or probe FramePicks security controls, authentication, authorization, or access protections without written permission.
9. Copyright and Takedown Requests
If you believe content on FramePicks infringes your rights or was uploaded without authorization, please contact us at support@framepicks.com. Please include your name and contact information, a description of the content and why you believe it is unauthorized or infringing, and proof of ownership or authority if available.
FramePicks may remove or restrict access to reported content while reviewing. FramePicks does not currently operate a formal DMCA designated-agent process.
10. Privacy
Use of FramePicks is also governed by our Privacy Policy.
11. Data Retention and Deletion
Photographers may delete projects or request account deletion by contacting us. Deleted content is removed from active systems but may remain temporarily in backups, logs, or service-provider systems.
FramePicks is not permanent photo storage and is not a substitute for your own image backups or client records. FramePicks may remove inactive beta projects or accounts.
12. Security
FramePicks uses reasonable technical and organizational measures designed to protect accounts, projects, galleries, and uploaded content. No online service can be guaranteed 100% secure.
Users are responsible for protecting gallery links, passwords, and account credentials. Unauthorized security testing is prohibited.
13. No Warranty
FramePicks is provided “as is” and “as available” without warranties of any kind. We make no guarantee of uninterrupted service, error-free operation, availability, or data preservation.
14. Limitation of Liability
To the maximum extent permitted by applicable law, FramePicks and its operators are not liable for lost profits, lost business, lost data, client disputes, missed deadlines, unauthorized gallery sharing by users, reliance on beta features, or any indirect or consequential damages.
Note: This limitation of liability section should be reviewed by a qualified attorney before FramePicks expands beyond controlled beta.
15. Termination
FramePicks may suspend or remove access if users violate these Terms, or if content appears infringing, unlawful, abusive, unsafe, or otherwise harmful. Beta access may be revoked at any time.
16. Updates to These Terms
These Terms may be updated before and after public launch. Continued use of FramePicks after updates are posted constitutes acceptance where permitted by law. We will make reasonable efforts to notify users of material changes.
These Terms have not been reviewed by a lawyer and should be reviewed by qualified legal counsel before FramePicks launches publicly or expands to new markets.
